    落閘,指全國人大常委會於2014年8月31日通過香港普選框架,完成「政改五部曲」的第二部。從2017年開始,要成為行政長官候選人,便要得到提名委員會半數以上委員支持,候選人數目局限2至3個,而提委會的人數維持1200人,構成及產生辦法均按照選舉委員會四大界別的組成。

    以往,要成為行政長官候選人,只需提名委員會八分之一以上委員支持,是次決定,除了「落閘」,限制了提名權和被選權,排拒非親中人士成為候選人,令選舉不公平,更被視為倒退。

    按全國人民代表大會常務委員會關於《中華人民共和國香港特別行政區基本法》附件一第七條和附件二第三條的解釋, 行政長官應就行政長官產生辦法的修改問題向全國人民代表大會常務委員會提出報告,由全國人民代表大會常務委員會確定。而按中國憲法第六十二條第十一款,全國人民代表大可改變或者撤銷全國人民代表大會常務委員會不適當的決定。故人大常委的工作是確認或是拒絕特區政府的政改報告,「落閘」決定亦非不能更改的。

    Refers to the decision of the Standing Committee of the National People's Congress on 31 August 2014, and specifically step two of the "five-step political reform" framework for universal suffrage in Hong Kong. This essentially means that, from the beginning of 2017, candidates wanting to secure nomination to stand for the Chief Executive election will have to obtain the support of more than half of the 1,200 members of the Nomination Committee (NC). The number of candidates will be limited to 2 to 3. The composition and the method of selecting the NC will be in accordance with the four sectors as already determined for the Election Committee.

    Whilst in the past candidates wanting to secure nomination to the Chief Executive election need to obtain just over one-eighth of the Election Committee members’ support, they will now require endorsement by over 50% of NC members. The NPCSC decision is regarded as retrograde and unfair because, through severely limiting would-be candidates’ right to be nomination and the right to be elected, candidates of differing political opinion would be excluded.

    According to the explanations contained in article 7 of Annexe I and article 3 of Annex II of the decision of the NPCSC in reference to the Basic Law of the Hong Kong, the Chief Executive shall report on the question of the method of amending be the Chief Executive to the Standing Committee of the National People's Congress, which shall then endorse as appropriate. In addition, according to the eleventh paragraph of Article 62 of the Chinese Constitution, the National People's Congress may alter or annul any inappropriate NPC Standing Committee decision. Therefore, the work of the Standing Committee is merely to endorse or deny the Hong Kong government's report on political reform, and the NPCSC decision is not immutable.
